Levemir Patent Expiration and Implications
Levemir, a long-acting insulin analog, was first approved in 2005 for the treatment of diabetes. However, due to patent extensions and exclusivity agreements, the original patent for Levemir held by Novo Nordisk expired in 2014 [1] in the United States. However, the patent on the method of manufacturing and delivering Levemir's active ingredient, insulin detemir, still held by Novo Nordisk expired in Europe in 2016 [2].
Although the original patent has expired, the follow-on exclusivity agreement for Levemir expired on 28 October 2023, in Europe. Biosimilar Competitors and Patent Lawsuits
Several biosimilar versions of Levemir, such as Admelog and Ryzodeg, were approved by the European Medicines Agency (EMA) and the US FDA in the years preceding the patent expiration. However, the exclusivity agreement may still provide some protections for Novo Nordisk, and patent lawsuits remain a possibility [3]. Biosimilar manufacturers, such as Mylan, Sandoz, and Fresenius Kabi, have been developing their versions of Levemir in the years preceding the patent expiration. However, these products may still be subject to various regulatory hurdles and patent challenges before they gain approval.
Implications for Patients
The expiration of the patent agreement for Levemir may lead to increased competition, which in turn can lead to cost savings and better access to the medication for patients. Additionally, patients may have more options for treatments, including cheaper biosimilar versions of Levemir.
